Privacy policy

This policy describes what personal data the operator of the Evergreen Residence apartments processes in the course of booking, hosting and running the website, on what legal basis, for how long, and what rights you have in this respect. Data processing follows Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Hungarian Act CXII of 2011 on informational self-determination (Infotv.).

2. What data we process and why

The table below sets out our data processing by purpose. We only process the data that is necessary for the given purpose.

2.1. Accommodation booking and performance of the contract

Data processed: name, e-mail address, phone number, arrival and departure dates, number of guests, messages relating to the booking, payment-related data.
Purpose of processing: recording and confirming the booking, performing the accommodation service contract, keeping in touch during the stay.
Legal basis: performance of the contract (GDPR Article 6(1)(b)).
Retention period: 5 years from performance of the contract (the general limitation period under the Hungarian Civil Code).

2.2. Invoicing and accounting obligations

Data processed: name, billing address, details and price of the service, tax number (if the guest requests it).
Purpose of processing: issuing and retaining invoices as required by law.
Legal basis: compliance with a legal obligation (GDPR Article 6(1)(c)).
Retention period: 8 years, under Section 169(2) of Act C of 2000 on accounting.

2.3. Recording guest data: VIZA and NTAK

Data processed: the guest's surname and forename, birth name, place and date of birth, gender, nationality, mother's name, the type and number of the identity document or passport, Hungarian address or foreign place of residence, the start and end dates of the stay.
Purpose of processing: the recording of guest data required by law in the Guest Information Closed Database (VIZA), and daily data reporting to the National Tourism Data Supply Centre (NTAK).
Legal basis: compliance with a legal obligation (GDPR Article 6(1)(c)), under Act CLVI of 2016 on the state tasks of developing tourism regions.
Retention period: for the period set out in the law. The accommodation provider deletes the document copy data stored locally on the day after transmission to the VIZA system.
Important: providing this data is a legal obligation, and without it the accommodation cannot be used.

2.4. Tourism tax

Data processed: the guest's name, date of birth, number of guest nights, any circumstance giving rise to an exemption.
Purpose of processing: collecting and declaring the tourism tax to the competent local authority.
Legal basis: compliance with a legal obligation (GDPR Article 6(1)(c)), under Act C of 1990 on local taxes.
Retention period: until the right to assess the tax lapses, under the Hungarian act on the rules of taxation.

2.5. Contact by e-mail or by phone

Data processed: name, e-mail address or phone number, the content of the message.
Purpose of processing: answering the enquiry and making an offer.
Legal basis: the consent of the data subject (GDPR Article 6(1)(a)), or steps prior to entering into a contract (GDPR Article 6(1)(b)).
Retention period: 1 year after the enquiry is closed, or until consent is withdrawn.

2.6. Running the website, server logs

Data processed: IP address, time of the visit, page viewed, type of browser and operating system.
Purpose of processing: secure operation of the website, troubleshooting, prevention of abuse.
Legal basis: the legitimate interest of the controller (GDPR Article 6(1)(f)) in operating the website securely.
Retention period: no more than 30 days.

The website does not use any traffic measurement, analytics or advertising service, and does not build profiles of visitors. No automated decision-making takes place.

3. Who can access the data

We do not sell your personal data and we do not pass it to third parties for marketing purposes. The following partners, acting as data processors, handle data only to the extent necessary to provide the service, and on our instructions:

Booking systemOnline booking takes place in the foglalas.appartman.hu system, which appears embedded in the website. The data provided during booking is handled by the operator of that system.

Under a legal obligation we transfer data to the Guest Information Closed Database (VIZA) and to the National Tourism Data Supply Centre (NTAK), and for the tourism tax to the Municipality of Debrecen. In the case of an official request we disclose data within the scope set out by law.

Embedded services from abroad: the map shown on the website loads from Google Maps and the typefaces from Google Fonts. These services receive the visitor's IP address. You can read about Google's data processing at policies.google.com/privacy. Details are in the Cookie policy.

4. Data security

The website is available over an encrypted (HTTPS) connection. Access to our systems is password protected, and only those who need the data for their work can access it. Paper documents are kept in a locked place.

5. Your rights

You have the following rights in connection with the processing of your data. You can make a request at info@evergreenresidence.hu, and we will reply within one month at the latest.

Access: you can ask whether we process data about you and, if so, what.
Rectification: you can ask us to correct inaccurate data and to complete incomplete data.
Erasure: you can ask us to delete your data if the purpose of processing has ended or you withdraw your consent, unless the law requires us to retain the data (for example an invoice or VIZA).
Restriction of processing: you can ask us to store the data but not use it, for example while its accuracy is disputed.
Data portability: you can request the data we process on the basis of consent or a contract in a structured, machine-readable format.
Objection: you can object to processing based on legitimate interest.
Withdrawal of consent: you can stop processing based on consent at any time. This does not affect the lawfulness of processing before the withdrawal.

6. Remedies

If you feel that our data processing infringes your rights, please contact us first at info@evergreenresidence.hu, as most questions can be resolved quickly this way.

7. Changes to this policy

We reserve the right to amend this policy if our service or the legal environment changes. The version in force at any given time is available on this page. We notify guests with an existing booking by e-mail of any material change.
